These 2 men committed the crime on 7th of January at Avery hill road, Eltham in the early hours of the morning. The victim at the time of the crime called the police saying that he had been approached by a male. Who headbutted him then proceeded to demand both his phone and money. With his friend the victim ran back to university accommodation. One of the men was charged with bladed articles possessions as well as assault on an emergency worker by beating them. Also, he was charged with having a class B drug, the other man was charged for possessing bladed articles. They are both charged with attempted robbery. When taken to the police for custody one of the guys spat at two officers, reportedly. Suspects are to be put on trial at court on the 8th of January. When these men were arrested, they would've been cautioned, which is: ’You do not have to say anything but it may harm your defence if you do not mention, something which you may later rely on in court. Anything you do say may be given in evidence’. They would be arrested under Section 24 PACE of 1984 and the situation meets the criteria for robbery. A person is guilty of robbery if they steal and immediately before or at the time of doing so, they use force on any person or puts or seeks to put any person in fear of being then and there being subjected to force
